Terms of Service

1. Acceptance of Terms

By accessing or using the FieldScout mobile application ("App") and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We may modify these Terms at any time. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

2. Description of Service

FieldScout is a weed management application that allows users to:

  • Tag and record the GPS locations of weed infestations
  • Document infestations with photos and notes
  • Track treatment progress
  • Share weed location data with team members
  • Mark and calculate areas of infestation

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

You must be at least 13 years old to create an account and use the App.

4. User Content

You retain ownership of any content you submit to the App, including weed tags, photos, and notes ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and display your User Content solely for the purpose of providing the Services.

You are responsible for your User Content and represent that:

  • You own or have the right to submit the content
  • The content does not violate any third party's rights
  • The content does not contain any unlawful material

5. Team Features

The App allows users to form teams and share weed data. By joining a team:

  • Your weed tags and related data will be visible to all team members
  • Team administrators may have additional permissions to manage team members and data
  • You agree to use shared data responsibly and only for legitimate weed management purposes

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Interfere with or disrupt the App or servers
  • Attempt to gain unauthorised access to any part of the App
  • Use the App to transmit any malicious code
  • Impersonate any person or entity
  • Harvest or collect information about other users without consent
  • Use the App in any way that could damage our reputation

7. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by FieldScout and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy of GPS coordinates or location data
  • Warranties regarding the effectiveness of any weed management approach

GPS accuracy depends on your device and environmental conditions. We do not guarantee the precision of location data.

9. Limitation of Liability

To the maximum extent permitted by law, FieldScout shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or goodwill
  • Property damage resulting from weed infestations
  • Costs of procurement of substitute services
  • Any damages arising from your use or inability to use the App

The App is a tool to assist with weed management. It is not a substitute for professional advice. You are solely responsible for any decisions made based on information from the App.

10. Indemnification

You agree to indemnify and hold harmless FieldScout, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Your User Content

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will cease immediately. You may request deletion of your data in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FieldScout regarding the use of the App.
